General Terms and Conditions
Fishing Camp Serravalle
1. Booking
With your registration you commission the Austrian Fishing & Adventure Camp with the organization of the fishing tours, including the additional services booked by you (e.g. a motorboat, log cabin...).
2. Payment
For the conclusion of the contract, payment of the full amount according to the booking confirmation must be made no later than 30 days before the start of the trip.
3. Specifications for services
The scope of the contractual services is determined by the service description of our current website. There are no minimum nights at the Austrian Fishing & Adventure Camp. The agreed nights as well as the booked additional services apply. In principle, the arrival and departure is carried out by each participant at his own expense and risk. The exception is the additional booking of our "airport transfer".
4. Resignation
You can withdraw at any time prior to travel. The declaration of withdrawal should be made in writing. If you withdraw from the contract or do not make the trip, we may demand a reasonable replacement for the reservation and travel arrangements made by us, as well as our expenses:
– if you cancel 29 to 15 days before the booked arrival date: 75% of the travel price.
– for cancellations 14 days before the booked arrival date: 100% of the travel price.
5. Liability
The organizer Austrian Fishing & Adventure Camp accepts no liability for force majeure and weather-related influences (flood, storm, rain, hail, etc.). The organiser cannot be held liable for personal injury and damage to property as well as for any changes to the law in the host country (Italy).
6. Limitation of Liability
Insofar as the organiser does not act intentionally or through gross negligence, the travel contract liability is limited to the simple travel price.
7. Liability condition
In the event of damage caused by improper or negligent handling of the equipment provided by us (boats, outboard motors, fishing equipment, etc.), the user or users of the equipment are fully liable. The return of the equipment to the owner Austrian Fishing & Adventure Camp, or to its respective representatives must be made in perfect and clean condition.
8. Obligation to cooperate
The instructions of the organiser /persons authorised to issue instructions must be complied with in the course of the general duty of care.
9. Withdrawal by the organizer
The organiser may withdraw from the contract without meeting the deadline before the arrival date or terminate the contract during the booked date without complying with the deadline:
1. If one or more persons permanently disrupt the execution of the fishing trip despite warnings and / or endanger themselves and others.
2. Where the implementation of the fishing trip is significantly endangered, difficult or severely impaired as a result of force majeure that cannot be foreseen at the time of conclusion of the contract.
If the organizer cancels (1st), then the travel price will be forfeited.
If the tour operator cancels (2nd) before the start of the trip, all amounts already paid by you will be refunded for this fishing trip. Further claims are excluded.
If the organiser announces (2nd) after the start of the trip, you will receive the part from the travel price that corresponds to the saved expenses of the organizer.
10. Insurance
The travel price does not include insurance.
11. Revocation instructions in accordance with the German Civil Code (BGB) and the Distance Selling Act
The cancellation policy is part of any contract between the Austrian Fishing & Adventure Camp and the respective contracting parties. With the booking, the contractual partner declares that he has read, understood and accepted the cancellation notice. The instruction can be found on the website of the provider.
12. Place of jurisdiction
The place of jurisdiction for all contractual disputes is Linz / Austria.
